Item was listed as "new without tags", but it is clearly used and smells disgustingly like tobacco smoke. The listing deliberately and falsely described the item. The accurate description would be "used filthy dress".
It is callous and mean-spirited and to send items with tobacco smoke that people can be allergic to and can endanger their lives.
I will ask eBay to honor their Money Back Guarantee or do a credit card chargeback. eBay should investigate the seller.
