It got up to 35% before dipping to 1% and now saying phone doesn't recognize battery. I want à refund or a phone with an actual Apple Battery. 400 paper weight

The phone was sent in a case which was unexpected. The cosmetic appearance of the phone was fair. A case will cover the chips and scratches but it was not excellent condition as advertised.
