Synopsis
A factory worker is fired because her boss dislikes the political bumper sticker on her car in the parking lot. Another is canned after refusing to display an American flag at his workstation. A flight attendant is grounded because her airline doesn't like what she's writing in her personal blog. Is it legal to fire people for expressing themselves, even when it's unrelated to performing their jobs? Can you lose your job because of a bumper sticker? For many American workers, the answer is yes. In ""Speechless,"" Bruce Barry confronts the state of free speech in the American workplace. He shows how employers and courts are eroding workers' abilities to express themselves on and off the job, with damaging consequences for individuals, their employers, and civil society as a whole. In defense of free speech in and around the workplace, Barry argues that the experience of liberty in a free society, as well as in life, in general, depends in part on the experience of liberty at work.

In Speechless: The Erosion of Free Expression in the American Workplace , Bruce Barry shows how corporate suppression of free speech in the workplace is increasingly damaging-for individuals, their employers, and for civil society as a whole. Using illuminating case studies and trenchant analysis, Barry outlines the substantial legal limits to free speech rights at work in the United States, and explores the many ways in which employers exercise their wide, state-sanctioned latitude to bar, censor, or chill employee speech, both during and after the work day. There are some limited legal protections covering speech on the job in public sector workplaces, Barry shows, but in the private sector, beyond protections connected with whistle blowing, unionized settings, and civil rights laws, there is for most workers no protection at all.

In this troubling analysis, Vanderbilt professor Bruce Barry shows how an erosion of freedom of expression available to American workers on the job (and after work) undermines both worker productivity and the indiivudal and collective ability to cultivate and participate in a democratic society. While most discussions of worker rights tend to focus on employees' right to privacy, no other popular trade work has examined the larger--and even more consequential--question of workers' right to free expression. Barry brings a rigorous analysis to this under-discussed topic.

This book addresses a hot button issue: A host of recent news stories have reported how workers have been reprimanded or even fired for expressing themselves through bumper stickers, after-hours political beliefs, and even blogs. As our forms of communication continue to evolve, the question of freedom of expression in the workplace will stay on the front burner and interest will continue to increase. It includes an innovative and unique treatment: Barry brings rigorous analysis to an under-discussed topic. While most discussions of the subject of worker rights tend to focus on employees' right to privacy, no popular trade work examines the larger (and even more consequential) question of workers' right to free expression. it is written by a credible and commited author: Barry brings authority to this project, both as an academic and an activist.
