The high bidder wins ... PERIOD …

If you want to do that, just reduce the price show below by
$9,900 …  and let me know that is your choice.

120. -1-1.4 in the Town of Angelica, Allegany County, NY.

This is THE  ONLY 5 acre Angelica parcel we have with this much frontage (340')!

The only reason this 5 acre parcel is available is because  the previous buyer experienced some financial difficulties and had to give it up …  their misfortune may be your opportunity It is the only one like it that we have  so bid accordingly ... when it’s gone … it’s gone.)

IF SO, you are welcome, but ... PLEASE TAKE NOTE: I need you to contact me BEFORE you bid and assure me that you have completely read, understand and AGREE to all of the terms and conditions in this auction description, and that you are a serious and responsible bidder, and that you will pay promptly at the end of the auction

In fact even if you've been on eBay awhile  ... PLEASE DO US BOTH A FAVOR …  READ  ALL OF THE FOLLOWING DESCRIPTION ... BEFORE you bid!

*  *  *

Now, having stated that ...  Why should you buy this prime location wooded country get-a-way with an Amish built Log Cabin . . . for less than 500 bucks a month ... without any of the traditional real estate buying hassles . . . and NO up front closing costs ?

. . . And why should you do it now ... while you're still young and healthy enough to enjoy it . . . ?

I'll address both of those questions later ... but, first let me tell you more about me and the land I'm offering at auction.

*  *  *

Hi... and thanks for taking a look at our auction!

If you are a regular follower of our auctions, you need to re-read this auction description because we have made a number of changes.

If you are new to our auctions ...  welcome aboard!

This auction is for THE DOWN PAYMENT ONLY for 5 acres of wooded land INCLUDING An Amish built  LOG CABIN (to be constructed) located in the Township of Angelica, in southwestern New York State … about 20 miles from the Pennsylvania boarder … And is designated as lots # 9 ... with a fixed purchase price of $34,900...

Financed by us at only $498 per month … ! (That's about what you would pay each month for a modest new car or truck ... BUT ... if you win this bid ... in a few years you'll have a fully paid for country get-a-way ... instead of a worthless "rust bucket".)

(Or get a $3,000 DISCOUNT with a $32,900 'Buy It Now' CASH bid ...)

(Contact me directly at inspent@aol.com if you have any difficulties with this option, or any questions)

"If you had a magic wand that could produce any kind of a country get-a-way you want ... what would it be like?"

Here are some feedbacks from a couple of our recent buyers...

Hi I'm George and I have bought two Angelica parcels from Jack.
This man has stood by his word 100% and I would trust
him with my life. I originally bought 5 acres and
later decided to change properties to 10 acres on top
of the mountain. There was a delay on getting a
building permit on the lot I wanted because I needed
to go to a town meeting to request one. Rather than
wait the few weeks I wanted to start on MY schedule.
Jack went out of his way and in a matter of a day or 2
had swapped my parcel and taken care of everything.
Everything he does seems to be for the people who
purchased property from him. Ask any questions of him,
He answers quickly and doesn't make it seem like a
chore to answer you. I've talked to him personally and
find him to be intelligent, personable and will bend
over backwards for you if you treat him with the
fairness and respect that he has earned. Hope this

. . . George Mika

"First I must compliment you on your honest representation of these parcels of land, they are exactly as you say and so much more... (Feel free to quote me and to use my email as a satisfied customer reference)."

 . . .  Bob Wood

This 5 acres of land  AND Amish built Log Cabin (to be constructed) is located on a private driveway which is off High Street (a Public Road  plowed and maintained year-round)  in the Village of Angelica, NY.

To give you an idea of how large 5 acres is, it's about the size of a city block  ... or about enough area for 18 or 20 normal city house lotsplus we also give you the right to hunt or hike on the unsold remainder of our 117 acres.

This IS the  ONLY 5 acre PARCEL we have THAT SETS RIGHT ON TOP OF THIS MOUNTAIN ABOVE THE LOVELY PICTURESQUE VILLAGE OF ANGELICA  ... so bid accordingly.  When it's are gone ... They're all gone.

The present 5 acre parcel that is up for auction, upon which your Amish built Log Cabin will be constructed, has about 340  feet of frontage on the Private Drive ... (See the map in the photo section) ... and it is arguably one of the NICEST LOTS WE HAVE IN THAT IT HAS ITS OWN ARTESIAN SPRING and has a nice large area of relatively level land near the private drive on which to build the Amish built Log Cabin

If you go back up to the top to the DESCRIPTION BOX and click on the Display Map link it will take you to a Map Quest map with a RED STAR located right at the point on High Street where the Private Drive leading to this land begins.

Once you get the map on Map Quest you can switch from Street Map to Aerial Map by clicking the tabs in the upper right hand corner of the map.

The Private Drive we recently constructed is too new to show up on the "street map" view of Map Quest ... but, when you switch to the "aerial map" view you can see it very plainly. And if you look at the topography/plat map in the photo section you will be able to see precisely where it is situated. Map Quest recently updated its "aerial map" view so I highly recommend that you check it out. It will show you amazingly detailed terrain features...

This parcel is located about 2,955’ up the Private Drive from where it begins on High Street … SO YOU WILL BE REALLY SECLUDED.

This parcel is in the middle of a HUGE extent of the woods (which shows up on the aerial photo in the picture section).

If you click on the Neighborhood Profile   in that same above DESCRIPTION BOX if will give you tons of useful information ... for example ... the water quality here is much higher than the average for the nation ... and the crime rate is lower ... etc.

This land is perfect for all get-away-seekers, nature lovers, hunters, and snowmobilers, etc. that want to be in the woods ... off the beaten path ... but, still have relatively easy access by way of a public year round PAVED road (high Street) right up to the beginning of the Private Drive.

Plus it is only about one mile or so away, as the crow flies, from the first of thousands of acres of County and State Forests (Bald Mountain State Forest being the closest State Forest).

The topography map in the picture section shows the lot and the surrounding area and also shows the large extent of the wooded land around it (in green shading).

There are literally dozens of close by State Forests with over 50,000 acres of land that you are free to roam or hunt at your pleasure.

Two of the adjoining Towns, Birdsall and West Almond, both are about 40% State Forests ... with very few people.

A GREAT LOCATION ! (location … location :)

All of the photos are taken on or from this actual 5 acres except the photos of the Log Cabin … which will be custom built using the same design as shown to the size you choose.

Because most of the photos are in the woods the field of vision was rather limited.

This 5 acres of land is just about totally wooded recreational/residential land ... but there are a few small openings here and there in the woods ... and it is also surrounded on three sides by woods … PLUS it has a l level parking area RIGHT NEXT TO its road frontage.

We're starting the bid at only $99.

All of the photos are either taken on or from this land, or very close to it. (Except for those labeled otherwise.)

The topography map in the picture section shows the large extent of the wooded land in this area (shaded in green).

You are bidding on THE DOWN PAYMENT ONLY.   The full price (with owner financing) of the land WITH an Amish built  Log Cabin (to be constructed) is only $34,900

The minimum payments are set at only $498 per month ... but if you wish to pay more each month you will shorten the length of the loan ... and pay less interest over the life of the loan. (I make less in you pay more than the minimum each month  … but you save a ton of money … and the time to pay off in full is drastically shortened.)

Out of each payment interest of 1.07917%/per 30 days on the unpaid balance (12.95% APR) will be deducted first, with the rest of the payment applied to the principal (i.e. deducted from the unpaid balance).

You may pay off the balance in full at anytime without any penalty or fee.

This is a NO RESERVE auction ... the high DOWN PAYMENT bid wins ... period!

What do you need to make you comfortable enough to purchase some real nice country land on eBay ?

This land and deal is guaranteed to be just as described ….

There is . . .

NO Realtors !

NO Lawyers !

NO attorney fees

NO up front fees or CLOSING COSTS of ANY kind

NO extra fees for a Warranty Deed (Warranty Deed is included)

NO extra fees to get an Instrument Survey (Survey is included)

NO extra fees for boundary line Survey Stakes (Stakes are included)

NO fees for a Search (Abstract) (Copy of our Search is included)

NO time wasted running around looking for the “right” deal … or the right land.

All you have to do is decide if you can afford $498/month … and how much you want to bid on the down payment … WE DO ALL THE REST !

A.  Pay us whatever you bid for the down payment.

B.  Pay us at least $498/month.

C. Pay us a flat fee of $300 per year (presently) to cover payment and administration of all Real Estate taxes.

If you elect to pay $18,000 or more down I will transfer the deed and begin the Amish built Log Cabin construction immediately (upon receipt of the recording fees … and weather permitting on the construction).

If you pay less than $18,000 as a down  I will need to see you make 12 on time payments before I record the deed or start construction.

In the latter case, the amount applied to principal for the first 12 payments will be considered additional "down Payment".

After you have paid at least 12 consecutive on time, payments   the total principal amount paid during that period will be added to your winning bid amount and accepted as the "total down payment".\

At that time, I will then record the deed to you ... and take back a wrap around mortgage (with a “deed in lieu” provision in case of default) securing the balance still owed. (In this case, I will also bill you for the recording fees at that time of recording.)

The monthly payments will remain the same at a minimum of $498, but the deed will be immediately transferred to your name at that time.

This is far better for you than not recording the deed until the land is paid for in full, as is often done on other financed land auctions listed on eBay

My greatest claim to fame is that I was an Airline Captain (for the predecessors of what is now know as US Airways) for a number of years. And, instead of buying stocks, I bought land ... lots of it. I’m 71 now (as of last January 5th) ... and it’s time to start sharing some of that land. (Kind of like "paying it forward")

eBay has opened up a whole new and exciting world ... and mode of doing business for all of us.

Our intent is to offer a unique way of using eBay to give you an opportunity to own your own little place in the country … away from the hustle and bustle... and the "rat race" of the cities.

And you don't have to worry about the substantial upfront closing costs and attorney fees that are often required when buying real estate...

Plus we offer guaranteed financing to ANYONE who wants it ...

So if you don't have the right credit ... or you don’t want to have to jump through all the “hoops” required by banks ... or you don't have the substantial legal and closing costs normally required ... then this may be a unique opportunity for you to get started right NOW ... WITHOUT HAVING TO GET A CONVENTIONAL MORTGAGE IN THE PRESENT DEPRESSED FINANCIAL MARKET.

What you've previously done with your credit is of no concern to me. If you've done good ... congratulations …  But, if you've made some mistakes ... chalk it up to "the cost of your education". It's what you do from here on out that counts.

As you undoubtedly know, Today is the beginning of the rest of your life. If you give me your word ... keep it ... and we'll both feel good about it ... and have no need to look backward.

We want to offer this land to you in such a way so as to reduce your risk as much as possible. Thus, our guarantee . . .

First, this land, and this deal, must turn out to be just as I describe them to be;

Second, we give you a Warranty Deed (at no extra cost to you), which guarantees a good and marketable title, free and clear of all liens and encumbrances outside of the mortgages ... not just a Quit Claim Deed ... which does NOT guarantee the title.

We also eliminate all the legal Gobbledygook and Mumbo Jumbo ... and make the transaction as simple as possible for you. We take care of all the legal paperwork, and pay all the up front closing costs.

For what it's worth ... our attitude is that we’re dedicated to do whatever it takes to consistently endeavor to make this an easy and peasant experience and transaction for you

We really mean it when we say we’re at your service!

Buying land from us is extremely simple and easy . . .

All you are required to do is pay us whatever you bid for the initial down payment for property... and then pay us at least $498 per month ... all on time ... and that is all you have to do.

Outside of what you bid for the down payment you do not have to pay for anything else up front!

We do, and pay for, all the rest up front stuff.

Before I get into the specific about the land AND the Cabin ... let’s do a little "imagining".

  • Imagine reaching down and grabbing a handful of dirt and knowing that all the  dirt for hundreds of feet in every direction ... and all the trees thereon (AND A PICTURESQUE CUSTOM AMISH BUILT LOG CABIN) all belong to you... and your children... and your children's, children ... or heirs … FOREVER !
  • Imagine just sitting quietly in the woods and listening to the sounds of silence.
  • Imagine having your own country getaway... where you can show your kids, or your spouse, (or significant otherJ) about camping, or hunting, or wildlife, or birds, or how to shoot ... or how to just enjoy the wonders of nature … together.
  • Imagine having your own secluded place in the woods where you can get away from all the things that drag you down and sap your energy and emotions in the workaday world.  A place where you can recharge your battery.
  • Imagine having your own country place where you can design and build your ultimate retirement retreat ... just the way you've always wanted.

Well... this land ... in conjunction with your imagination ... can make any of these things ... and a hundred others ... come true.

All you have to do … is ACT!

THE LAND ITSELF : ... The pictures tell most of the story ....

Many who have won our auctions invariably say that the land turns out to be BETTER than the pictures.

Keep in mind that we took some of these photos in the fall of the year  ... so things can look rather different in summer when everything is growing … or in the winter when the trees are bare and there is snow on the ground.

This land is just about totally wooded, but there are a few small openings here and there in the woods.

If you have a chain saw you can keep it pretty busy cutting plenty of firewood.

This land is reasonably level in the front (east) with a stronger slope to the rear (west).

You can get an idea of the terrain from the survey/topography map in the photo section.

The USGS Topography Map I included in the photo section will also show you the extent of the woods (in green) as well as the surrounding area.

This land even has some thick pine cover nearby that the big trophy bucks love to hide and bed down in.

This 5 acre parcel of land is the ONLY PARCEL WITH THIS MUCH FRONTAGE (340') and is rather RECTANGULAR shaped.

The front of Lot #9 (it's East sideis about 340 feet wide and fronts on the private driveway for that entire 340 feet. The north side is 840 feet long. The south side is 764 feet long. And the west side is 222 feet wide.  It is 5.0109 acres in size.

The survey/topography map in the photo section will show you the approximate bearings and distances, and the shape of the land and the elevations of the terrain look like. (Each brown contour line indicated a difference of 20 feet in elevation ... and the green shaded areas indicate older wooded areas.)

You WILL receive an original stamped copy of the Instrument Survey that we recently had prepared by a Licensed Land Surveyor. And there ARE Surveyors stakes in all corners and/or angle points of this lot … All this at no cost to you.

FYI this survey cost me $4,000 to have done.

This land is quite private and quiet. So if you really want to get away from it all, but still have reasonably easy access … this lot may be for you.

 It is definitely buildable!

It is essentially duel purpose land … equally well suited for a secluded recreational get-a-way, or an out-of-the-way permanent home ... and yet close enough to walk to the center of the village in only a few minutes.

There are two municipal entities that our 117 acres spans ... the Town of Angelica, and the Village of Angelica. This parcel is actually in the Town.

There are presently NO zoning regulations or ordinances in either the Town or Village of Angelica ... so you can pretty much do ... or build ...  what you want... at least for the time being.

But ... things they are a-changin'.  The Village is already in the process of reexamining and perhaps revising their local laws about what you can and can't do with your own land.

(The TOWN has rejected that same proposal ... which I think makes more sense.)

They call this progress ... but, I have my reservations about that.   This kind of progress just makes it tougher and tougher to do what I do  ... i.e.  Make land available to the average Joe and Jane at a reasonable price.  All this "progress" just drives the price of country land up more and more.

Oh well ... this is a sign of the times we live in. Many previous freedoms are being eliminated.

All the more reason to get some country land now ... while you are still able to do so.

All timber and surface mineral rights are included and will go to the winning bidder ... forever.  There are quite a few timber grade trees on this parcel that have some timber value.

There are homes on the High Street ... but, once you go up the Private Drive and into the woods, permanent neighbors are nonexistent ... and seclusion and wildlife abound.

There are a number of the lovely hiking/sno-mobile/atv/horse trails in the area.

Most of the soil in the area appears to be moderately well drained and should percolate OK … but, in any case, a sand filter type system can usually be approved and used on such a large lot if slower percolation is encountered.

Included with this purchase is a nice little custom Amish built Log Cabin that will be constructed as set forth below.

This cabin is our original basic Amish built Log Cabin... it has about 300 square feet of enclosed area (larger cabins up to 1,500 s.f. are also available).

As a bonus we will also include the following :

·        Solid panel metal door

 ·        Five interior windows (two in the loft and three on the first floor)

·        GUARANTEED OWNER FINANCING  - Your total land and Amish built Log Cabin Package payment is only $498 per month.

·       NO ADDITIONAL DOWN PAYMENT WILL BE REQUIRED! (However, if you do decide to pay at least $18,000 for your down payment construction of this included Amish built Log Cabin will begin within 4 to 8 weeks (weather permitting – or, if not, in the spring when weather permits again)… otherwise you will need to make at least 12 consecutive on time monthly payments before construction will be started.)

This Amish built Log Cabin will have a 10' X 14' first floor with about 7' headroom, and a 12' X 16' loft with about 5'-6" maximum headroom (The loft is accessed by a pull down attic type stairs).

The interior of the loft is extended (cantilevered) out about 1 foot on each side and about 2' in front of the first floor enclosed area.

The roof is cantilevered out 1' on each side and 4’ beyond the front wall of the 1st floor and 2’ beyond the rear wall.

There is a total floor space (main & loft) of about 332 square feet.

This Amish built Log Cabin will not contain any interior dividing walls, counters, kitchens, bathrooms, plumbing, or electrical wiring, septic system, or well, etc.

This will be just the basic Amish built Log Cabin "shell". But, it is should serve very nicely as a small camp, or initial base of operation ... or later as a guest house or storage building if you someday decide to build a larger building.

The pictures shown in the photo section are actually of other Log Cabins that we recently completed on different lots.

The design and construction of this included basic Amish built Log Cabin will be the same as the one shown in the first picture in the photo section … except it will not have upper front and rear decks, the front porch & steps or shutters. They are available as options at additional cost.

If you wish to have the cabin be larger, we can do so up to about 900 square feet, AS AN ADDITIONAL OPTION, at an extra cost of $35/square … or, up to about 1,500 s.f., at an additional cost of $40/s.f.  All of which can also be OWNER FINANCED with similar terms as set forth above. Contact us for details.

There are a number of other options that can be added to this package, all of which can also be OWNER FINANCED.

If you wish a quote on an Amish built Log Cabin customized to your specific needs and desires, just email me and I will be glad to accommodate you in every way I can.

We are also offering an optional wind turbine generator electric package for anyone who wants to be electric independent and off the grid. The entire erected and fully operational wind turbine package is available as an option for an additional $4,950.

It includes a wind turbine mounted on a 100' guyed tower, with all the wiring and 4 deep cycle batteries and a 2,500 watt inverter, grounding rods, switches, etc. It will be completely constructed and ready for you to plug into if you elect to purchase it.

We also offer owner financing for this Wind Turbine Package with 50% down.

This parcel has a nice artesian spring that can be easily developed into your own private spring fed water supply

This parcel also has a possible potential pond site on it. I have not yet constructed a pond on it ... but I love to operate dozers (My wife calls them Jack's BIG Tonka Toys) … and especially like to build ponds.   I have built dozens of ponds over the years.

I can build you a very nice pond as an option for an additional fee of as low as $4,000.

We can even finance part of the additional Pond costs ... if you are willing to put up at least an extra $2,000 up front. (This helps offset the cost of renting & operating the dozer.)

I'm willing to then finance whatever extra you may need for the pond with extra payments of as low as $100/month until paid in full. The length of time to pay off in full will depend on how much extra you want to finance and how big you want your payments to be.

Getting to this land is extremely simple and easy ... and fast.

You are only 3 or 4 minutes away when you get off I-86!

Get off I-86 at exit 31. If you're coming from the west, you turn left at the end of the off ramp and go about 4/10ths mile to the "T" at Main Street ... if you’re coming in from the east turn right off the exit and go about 3/10ths mile to the "T".

Turn left at the “T” onto Main Street and go west about a 2/10ths mile to the Village Green Circle. Go right around the Circle and continue west on Main Street about another 3/10ths mile more to High Street (it is about 5 or 6 houses past the Angelica Bed and Breakfast on the right).

Go up High Street about 1/10th mile to a sharp bend to the left  ... and you are there.

The Private Drive entrance is at an angle to the right off High Street towards the woods.

You make an immediate 45° right turn off High Street and onto the private driveway instead of following High Street around to the left … this is the beginning of our 117 acres.

We are doing some improvement on that Private Drive ... so it may be under construction for a while until we get it finished.

This is all shown on the survey/topography map in the photo section … and the entire Private Drive also shows up very clearly on the “aerial map” view on Map Quest

You will also have a virtually unlimited supply of firewood left over from the Best Forest Management Plan we completed about four years ago. There are a number of tree "tops" left over for you to use for fireplace wood or camp fires.  If you have a chain saw you will have a lot of potential firewood to use it on :)

We will also be given you a written copy of the “Best Forest & Wildlife Management Plan” that we had prepared by a Professional Forestry Consultant.

There is already some timber value on this parcel … and if you follow this plan, and make periodic selective timber harvests ... over the years there is a high probability that you can get back much  ... or perhaps all … of what you pay for this land by selling future timber.

That's one of the nice things about wooded land ... the timber on it is a self renewing natural resource ... it just keeps growing.

There are numerous great fishing streams nearby. The Angelica Creek is but a 5 minute walk (about a half mile away). And the Upper Genesee River is only about 3 miles (five minutes by car) to the west.

There is OUTSTANDING fishing in this upper area of the Genesee River. I have a recent article from one of the local newspapers that gives a great deal of information about the superb fishing in this area of the Genesee. It is truly a premiere fishing area for trophy size trout, bass and many other species of great game and eating fish. We include a copy of that article in the "documents package" we send you if you are the winning bidder ... but we will be glad to fax or email it to you now if you email us a request.

I personally pulled out about 20 bass the last time I fished there ... but, kept only four of the bigger ones that were all over 18 inches. About noon we even beached our little John Boat, built a small driftwood fire ... and fried one up in butter for lunch ... delicious!    Now that's real sport...

At the beginning of this description I posed two questions.

The first was ... should you buy this land ... and the second was ... should you buy it NOW?

Perhaps you have already figured out the answers to those questions on your own from what you've already read.

If not, I will give you my version of the answers a little later.

Read on...

There are a number of marked and groomed Snowmobile Trails accessible from this land.

And this land is right in the middle of the Ski Resort Area in what is know as the “snow belt” south of Buffalo, NY. Some of these Ski Resorts are within less than an hour drive from this land.

I don't believe I exaggerate when I say that this is literally a "Snowmobiler’s and Skier’s Heaven"

If there is one thing western NY State is famous for ... its lots of snow :)

There are also a number of dedicated, marked horseback riding trails set up by the State within some of the State Forest ... only a few miles away from this land.

They tell me they have complete facilities specific for the needs of horseback riding, feeding and corralling ... and camping.

Every year horsemen (and horsewomen) from far and wide trailer their horses in for the numerous wilderness trail rides held at these these sites.

This area of NY State has so much to offer it is hard to know where to begin.

For general information on all of Southwestern NY click on this link: http://www.discoversouthwestny.com/index.html

In addition to being only a few minutes walk to the Village of Angelica http://www.angelica-ny.com/, this land is also only about 30 minutes away from Wellsville, NY.

Now, at the risk of this sounding like too much hype ... I speak truly when I say that I believe Angelica is the prettiest and quaintest little Village in all of Western NY.

It dates back to the early 1800's.  And even back then if was a "planned community" in that it has a Village Green Circle ...  wide tree lined streets ... with many beautiful homes set way back from the street. And the small business section has been pristinely managed and kept as original as possible … even the US Post Office is an old fashioned “original”.  It’s truly very quaint.

The Village fathers ... and the good people of Angelica … work very hard at maintaining the 19th century aura.

I've never seen any other Village that has a permanent old fashion public CROQUET COURSE right on the Village Green (which is presently in the process of being completely revamped) ... now that’s "style" ... and every year they have tournaments open to the public.

I sincerely believe that if you get a chance to walk down its charming streets you will agree with me that this is truly a unique and romantic little “19th century Village” quietly tucked away in the foothills of the Allegany Mountains.

Wellsville, NY http://www.wellsvilleny.com/community.htm has everything from a K-Mart to a Texas Hot. It has all the things you would expect from a small city ... gas, food, hardware, Post Office, restaurants, motels, Bed & Breakfasts, Police Department, Jet capable Airport, etc. ... plus several large supermarkets, Lumber & Building Supply Outlets, a movie theater, department & specialty stores, drug stores and a full service Hospital … etc.

Wellsville also has lots of great activities like the annual Trout Fishing Derby http://www.trout-derby.com/index.html , and the fascinating and exciting Great Annual Balloon Rally http://www.wellsvilleballoonrally.com/ .

This land is truly in a very picturesque rural area … (while still having the advantage of everything you might need close by)... and it is loaded with all kinds of wild game, as well as many fishing streams.

Arguably, this is some of the best deer and turkey country in the world … and it is crisscrossed by numerous hiking, snowmobiling and horseback riding trails.

Alfred University http://www.alfred.edu/campus/, a world class higher education facility established in 1836 with  renowned ceramics and architecture departments, is only about 12 miles away to the southeast as the crow flies.

Your bid constitutes your agreement to buy as per the terms set forth herein ...

1. If you are NEW TO EBAY ... have zero ...or low (less than 10 positive feedbacks) ... or a lot of negative feedback (if you have a 98% or less feedback rating), please contact me BEFORE bidding. The purposes being for you to reassure me that you have completely read, understood and AGREE to all the terms, and that you will keep your word ... and act with integrity ... and pay your bid promptly if you win.

2. The full amount of the winning bid for the initial down payment must be paid as soon as the auction is over, either by direct wire transfer or by certified check sent by overnight delivery. The full amount of the initial down payment will then be deducted from the purchase price of $34,900

3. You then need to pay your monthly payments of at least $498/month starting  September 15th, 2012 and then by the 1st of each month thereafter beginning October 1st until paid in full. The length of the loan will be determined by the amount you pay each month (with a $498/month minimum). If you desire to pay only the minimum monthly payment, we can amortize these loans for up to 15 or 20 years ... but, you will save a lot of interest, and be paid off much sooner if you pay more.

Your individual amortized period will depend on how much you pay down ... and then the amount you pay each month. The more you pay the shorter the time until the loan is paid in full. That is why it is best to pay as much as you can each month. If there is still a balance owed at the end of 10 years, a balloon payment for whatever remains will be due at that time.

4. Interest will be calculated each month and deduced first from each monthly payment at the rate of 12.95% APR which shall be calculated per day by dividing 12.95% by 365 days which equals .03547945% per day. That daily rate of .03547945% shall then be multiplied by the number of days since the previous payment. That resulting percentage amount shall then be multiplied times the principal balance remaining after the previous payment.  The result will be the amount of interest subtracted from the present monthly payment. After the interest is taken out, the remainder of the present monthly payment will then be deducted from the principal balance remaining after the previous payment.

(If you make a payment larger than the minimum required, the whole amount which is paid over the minimum payment amount will be deducted from previous principal balance.)

(Don’t be concerned if this all sounds complicated. We will keep tract of everything for you. I only mention it here so you can be fully apprised of how the interest and payments are calculated and applied.)

5. When the entire balance is paid in full, a Discharge of the Mortgage will be recorded in the County Clerk's Office. At that time we will handle all of the document preparation and do the actual recording of that Discharge for you, and bill you for whatever small fees are required for that recording.

6. It usually takes the Town Assessor about a year to revise the tax roll to reflect you as the new owner. Until the tax bills start coming directly to you, we will simply forward them to you. The Town and County tax bills are due before January 1st of each year, and the School tax bills are due before September 1st of each year. Until the deed is transferred to you, you will be a lessee.

7. An additional fee of $25 will be due for each payment that is not received by me by the 1st of each month.

8. If any late monthly payment is not received by the 1st of the next month you will be in default. If such a default is not cured in 10 days (a total of 40 days) you will automatically lose all claims to the property, without further notification, and we will keep all money previously paid.

9. If the full amount of the down payment is not received within 24 hours after the end of the auction you will also be in immediate default and will have no further claim on me or to this land.

That's all there is to the terms.

It's really quite simple ... Just pay promptly as agreed !

There is NO small print !

Upon the conclusion of this auction, the pertinent parts of this description will be put into a written AGREEMENT, signed by me, and sent to you, which you will need to immediately sign and send back to me, which will be the governing Agreement between us.

Upon our receipt of at least the full amount bid we will forward you the following as they are prepared:

a. A signed written copy of the above mentioned Agreement (for you to sign and return), together with another signed copy of the Agreement for you to keep for your records.

b. A copy of the Warranty Deed that will transfer title to you.

c. Two copies of the Wrap Around Mortgage and Note for the balance of your purchase price. One copy of which must me immediately signed, notarized and returned to us.  (The second copies are for you to keep for your records.) We may break the total mortgage up into a 1st and 2nd mortgage depending on the needs and requirements of our lenders.

d. A copy of our original Abstract of Title (Search).

e. A stamped original copy of the Instrument Survey prepared by a Licensed Surveyor.

e. Two forms that the County requires that you must sign and return before we can record your deed. One form (TP-5217) is to notify the local assessor that you're the new owner. The second form (RP-584) accompanies the payment of the transfer tax.

f. A copy of our original fee Title Insurance Policy.

Last year the total amount allotted for the cost and administration of the taxes for this land was only about $300.00 (about $150.00 for School taxes, due each September 1st, and about $150.00 for Town and County taxes, due each January 1st).

Just e-mail me anytime (24/7) with any questions you may have, and I will be very glad to respond in detail as quickly as possible.

If I haven't answered you in 24 hours ... chances are I didn't get your email... in which case please email me again ... or call me at 585-437-2103

Please ...ONLY BID ... IF you understand AND AGREE to the terms... and that you further understand that this is a DOWN PAYMENT ONLY auction ... There are then minimum monthly payments of $498 to be paid each month until the loan is paid off … And that you’re going to PAY PROMPTLY as called for in the terms:

ALL arrangement for funds, research, questions and due diligence you may require to make you feel comfortable, should be completed BEFORE you bid. Feel free to e-mail me about anything. But, please ... ONLY bid if you are going to pay as bid.

I promise to keep my word and act with integrity ... I’m relying on you to also keep your word, and act with integrity. Let’s both be good eBayers ... and both end up with positive feed back after a good transaction.

We are offering a nice property, with very simple (and fully explained) terms. I consider my offering, and your bid, to be a legally and morally binding contract.

Your bid is an “electronic handshake” that indicates you understand and agree with the terms herein... and that you agree this is a binding deal, ... and that it guarantees your promise to pay promptly as set forth and required by the terms.

You also agree that it is just as real and binding as a personal handshake.

Please only bid if you like the property, and the terms, as described ... and if you accept the terms ... it will make both our lives a lot simpler.

Our Mission Statement and Core Values:

·         We offer good Country Land (and sturdy Amish built Log Cabins), at affordable prices and reasonable terms.

·          We make commitments with great care ... and then live up to them.

·          In ALL things ... we do what we say we are going to do.

If you are the winning bidder you must pay the amount of your winning bid  IMMEDIATELY.

Because of the collapse of the financial markets related to mortgages, PayPal recently changed its policy and NO LONGER ALLOWS REAL ESTATE RELATED PAYMENTS.

Therefore you will have to make your winning bid payment by one of the following two methods:

1.  Have your bank send a wire transfer directly from your bank to our bank (detailed instructions will be provided to you at the end of the auction).

or ...

I'm sorry for any inconvenience this may cause you but, that's the NEW 'Golden Rule' ... "Them with the gold makes the rules" ... and PayPal controls the 'gold'.

(To make it easier for you we WILL accept your personal check ...  IF you contact us and receive our approval  before you send it.)

Possession of the land:

You will have possession of this land IMMEDIATELY upon our receipt of your payment of the bid amount. For this and other reasons all payments are non refundable.

Fee Title Insurance Policy:

We have already paid for a Fee Title Insurance Policy on this property when we purchased it which indirectly also covers you by virtue of our giving you a Warranty Deed.

When special circumstances exist we do, occasionally, send out a "Second Chance” offer.

If you do get second chance offer please verify that it came form me by calling me at 585-437-2103.

. . . In conclusion… (finally:)

If you haven't already figured out the answers to the questions I posed to you at the very beginning ... I will now give you my take on them...

You must have a dream of having your own get-a-way in the country ... or you wouldn't have endured wading through this lengthy dissertation:)

If all of the features and benefits associated with this land  DO NOT meet your particular needs ... then the answer to the  first question is decidedly NO ... you should NOT bid on this land.

But, if they DO meet most of your needs ... well then you don't need me to tell you the answer that's right for you.

As to the 2nd question ... WHY you should buy now?

To answer  that I'll first tell you the tough lesson I learned from what happened to my own Dad  ... who worked hard for 47 years in a grimy foundry  ... and then died before his time ... with the music still in him ... before he had a chance to enjoy his golden years.

Secondly, I'll tell you the sad tale of a very nice couple who won the bid on one of my properties ... but never got a chance to enjoy their dream. Unfortunately, within a couple of days of the end of the auction she fainted. And when they did a MRI they discovered she had three inoperable brain tumors. *

Life is very short ... and sometimes much shorter than it should be.

I have learned to live each day as if it were my last ... and dance as if no one was watching.

If you want to do something ... do it ... NOW ... before you can't.

Seize the day ...

Take that for what it's worth.

*Now for "the rest of the story" as Paul Harvey used to say ...

I recently received the following emails from the husband of this very courageous lady that I am pasting below just as they were received:

Hello Jack,

I’m not sure if you remember me I've been watching your auctions, I am John  ... my wife Debbie and I were the couple that won  one your auctions a couple years back.

Debbie was my wife that fainted and  then was diagnosed with the brain tumors.  If you remember, it was only a couple days after winning your auction.

I noticed you have been giving people reasons why they should buy the land of there dreams now and not to wait.

I am glad you use Debbie and me as a good reason to do so.

Debbie was touched when I showed her your add that you remembered us ... and it is truly a very good reason to buy now and not wait ... because you never know what tomorrow will bring.

On a sadder note, not to ruin your day, my wife Debbie, who I loved very much, passed away a month ago.  She fought a long, courageous battle with the cancer.

I just wanted to let you know ... and thank you for caring.

I would be very appreciative if you would continue to use us as an example.

Sometimes life goes by so fast we don't stop ... and slow down ... and look at what we have ... before it’s gone.

Take Care Jack,

Sincerely Debbie and John

Wow ... what a beautiful ... and touching  ... and yet,  at the same time, sad ... story!

Thank you so much for sharing it with me.

I am much honored that you made the special effort at this time of great grief to send me this follow up story.

As you know,  I was so touched by your original story that I wanted to share it with everyone who reads my auctions.

Now, with your permission, I would also like to share "the rest of the story", as Paul Harvey used to say, with my future readers.

Perhaps it is an additional "legacy" that you and Debbie can give to so many others.

My heart reaches out to yours (and Debbie's) with very strong feeling.

Thank you Jack,

You are more than welcome to share our story.

If it makes just one person stop and appreciate what they have then it's all worth while.

When Debbie first got ill you would check to see how things were going  ... and I remembered that.

I felt you should know.

Good luck to you Yours.

Take Care Jack
