The other day, I wanted to sell a watch I had for a long time. It was supposively a Rolex watch. It was a watch that a roommate (a loser drug addict kind of poeple) had given to me as a way to pay me back money he owed me then. He had told me that these watches is a "Rolls Royce" of watches. I did not believe that one, cause it looked too dull and typical to be one of those, It looked to me like a watch you can buy at Walmart for $5 (I DON'T KNOW) and plus this guy is a loser!
10 years later (how long I had this Rolex), I decided, I never even used this watch, so why not sell it. So I put an ad on Ebay to sell this watch. I took beautiful pictures and a nice detailed description of watch, I started bid at 1 cent for a 7 day duration.
A day passes by, then on the second day, I was getting all excited cause I saw I had a lot of people looking at my item for. Then by the end of day, I turn on the computer and the Internet, then A SLAP IN MY FACE with an email from ebay : EBAY LISTING REMOVED - UNATHORIZED ITEM -REPORTED BY RIGHTS OWNER.
I say to myself WWWWHHHAAA! "WHAT DID I DO NOW, WTF MAN, GEE" I open up email, it says : "Your listing was removed because it VIOLATES ebay policy." Then it says : "The rights owner - Rolex - had notified ebay that this listing VIOLATES INTELLECTUAL PROPERTY RIGHTS"
I look at these stupid words and think to myself : "WTF is that, WHAT KIND OF LANGUAGE IS THAT????? What the hell did I do now?? TO THIS POINT, I AM COMPLETELY PUZZLED!
I contact ebay, I had asked them to explain this "in ENGLISH". They told me that I have infriged the trademark. Then they told me I can contact Gibney, Anthony & Flaherrty, LLP for more information.
I want to get to the bottom of things! I contact them by email, and asked whats wrong with my listing. Later Gibney emailed back saying "It is because the Rolex experts had successfully identified the item in question as counterfeit based on the photographs and description you provided" and also "Offering counterfeit Rolexes is agaist the law. As the result, you may be held liable for your actions"
After getting this threat email, I got really concerned now. I feel Im being hunted down, SCARING ME! I say to myself "BUT I DIDN'T KNOW IT WAS A FAKE ROLEX. I DIDN'T KNOW, I DIDN'T KNOW! Now causing TONS of anxiety in my mind, I can't think straight! "Am I going to get sued, jailed, etc???"
I hope nothing is going to happen to me! I say to myself.
So I just let the day pass by, hoping they are not to HUNT ME DOWN. One day passes, then next, then next. NOTHING so far, "thank god" I'm thinking.
It was a total of 5 days later. I turned the computer and internet, and SLAP IN MY FACE! I GOT AN EMAIL I DIDN'T WANT TO GET!!!!!!!!! It was from Gibney, Anthony, & Flaherty, LLP. I got a demand Cease and desist letter. (A THREAT LETTER)........OH another thing, they somehow KNEW my address! They sent me a letter in the mail box too. Ho ho ho I'M GONNA GET YA!
It basically demend that :
1. Surrender all illegal merchandise I posses
2. Provide the identity of source of the illegal merchandise
3. Make payment to "Rolex Watch USA.. Inc" by bank or certified check, or money order, for all damages and costs incurred by Rolex in connection with your illegal conduct, in the amount of $350USD.
STUPID WHEN THEY USE WORD "DAMAGES".... CRY BABIES
They gave me only a week to respond in WRITING, and to comply with these demands. Even with all this, this letter include one last paragraph of threat :
"This letter does not constitute an exhaustive list of Rolex claims or rights, all of which are hereby expressly reserved."
STUPID.. WHY THEY USE THOSE COLLEGE DEGREE WORDS?......Just F*CK*N say: "Even when you do comply, we can still sue you!
This is the wrost experiance I EVER had on ebay! This had caused me depression, I felt so "sick in my stomach".
To make things SO SAD and cold blooded of them. I decided sell my Xbox 360 and all my games to pay for THIER problem.
After some time, this "sickness in my stomach" now turned to ANGER. I think to myself : "IT IS SO COLD BLOODED OF ROLEX TO GET ON ME LIKE THAT. Not everybody knows about those stupid watches. Fake items can be lying around the town everywhere, any of us may find items like this in garage sales etc, NOT EVEN BEING TO TELL THE FAKE FROM THE REAL. And SADLY I had to pay the price for the most legimited mistake I made. That's NOT nice of them, can't they give some kind of warning, AREN'T THEY HAPPY WITH THE STUPID WATCH I HAVE GAVE UP TO THEM, GEE! Not all of us are know about those Rolexes! And realize that we need to check for real or fake before selling on the net.
To me, it's STUPID for Rolex to want $350 just because the honest mistake of offer for sale. How is that going to harm them, if a sale never happened. MAN, THEY MUST OF LOVED THAT MONEY. They made $350 out litirally NOTHING! Its SO UPSETTING because they are SO F****N GREEDY! They make $1000000s a year, and to TAKE money from a family who lives paycheck to paycheck. That is NOT NICE! It's so UNFAIR. The first thing that this Greedyness makes me think of, is the UNHOLINESS of Rolex.
Later on though, I had learned that I really DID NOT have to pay the $350.
DID YOU GET STUNG BY THESE "B*ST*RDS? Well, let me tell you. DO NOT GO DOWN WHITH OUT A FIGHT!.....
If you received this letter, I have heard that they only make the letter sound SCARY in hopes to make money off you. I have research about this. I have heard of one guy that did not respond to the letter, they did not "get him".
So all in all, I have learned that :
DO NOT PUT A COUNTERFEIT ITEM FOR SALE, any counterfeit item, it does not matter what it is! You need to check item before selling it.
It just NEVER came to my mind to check things like that before selling my watch. It never came to my mind that this could potentially happen
Nice pictures haa?? This is what a fake Rolex looks like. After extensive research, I have later learned that Rolex has never manufactured their watches with a clear see through backing. I CERTAINLY DIDN'T KNOW THAT ONE!!!!!!!
