DeWALT Items NOT available from "Authorized" Sellers?

Starting April 1st 2009, DeWALT no longer allows it's authorized vendors to sell DeWALT product on eBay or any other 3rd party platform (such as Amazon, Overstock, Buy, etc.)

DeWALT/ Porter Cable/ Delta brands are all owned by Black and Decker and are known as IPG (Industrial Products Group).  According to IPG, eBay, Amazon, and other 3rd party sites have emerged in the last few years as being major power players in the ecommerce landscape.  These sites are generally easy for anyone to sell products on which helps their appeal as popular places to go for a wide variety of products.

There is no process on any of these sites to make sure that the seller of the products are authorized by the manufacturer to sell these products.  Therefore, authorized and un-authorized sellers sell alongside each other.

IPG feels that the abundance of it's  products being offered on the sites by various authorized and un-authorized sellers compromises it's brand image as well as it's pricing structure. According to IPG: "Most Un-Authorized Sellers Violate IPG's IP (Internet Policy) & MAPP (Minimum Advertised Price Policy) Policy, and operate with "Flea Market" like product assortments".

According to IPG, the net result of IPG products being offered on 3rd party platforms is "Poor Policy Enforcement, and 3rd Party Market Emergence have Led to Non-Strategic, Non-Qualified Distrubtion on Our Books, and a Multitude of Un-Authorized Players Leveraging the 3rd Party Platform".

So what does this mean for sellers of IPG products? Authorized sellers are only allowed to sell these products on their own websites.  If these products are found being sold on 3rd party platforms by the authorized sellers, then the "Three Strike" policy is in effect which ultimatly results in termination of the ability to purchase IPG products from the manufacturer.

According to IPG, the Un-Authorized sellers are the main reason for not allowing authorized sellers to sell products on 3rd party sites. IPG has thretened legal action against anyone who sells IPG products for more than for personal use.  How this will happen in theory and what will actually happen remains to be seen.  Are IPG items available on eBay right now?
